I need legal help with defaulted student loan

I am 48 years old and I am not in a high paying job. Several years ago, I went to school. Went to work, but when the bills came in from the bank to pay off student loans. They said that the student loans, all together, added up to over 500.00 a month. I was not making that kind of money. The first three years of work, I didn't get over 22,000.00 per year. Now, understand this was on student loans that were not even over 18,000 total. After the loans went into default, I found out that I could of consolidated them. Bank didn't mention that. Once the loans defaulted, the Bank got their money. Texas Guarantee Student Loans then decided to garnish my wages (15%). That is ok. But it has been 15yrs and several years of not working (health reasons), I have paid over 36,000.00 dollars and they say i still owe almost 40,000.00. This is a hardship. It is said that a judge could abolish this loan if it will be a long term hardship. I figured that I will have paid over 150,000.00 and still owe over 200,000.00 by the time I retire. I could use that money. Can anybody help? At this point, I don't make much money and my spouse has been disabled for 20 yrs. This is a hardship. The food stamp office said we make 60.00 over their limit to get food stamps. That was 2 yrs ago. i got a 0.33 cent raise since then. wow. They don"t consider the over 250.00 that student loan takes. I would be under that limit. Please help.

Thanks to all. I am still paying back the student loan. I have now paid $38,000 dollars so far and I still owe 39K. It is a shame that student loans have that much power. And, I found that the student loans will garnish any disabilty or Social security that I would get in future. Man that is a lot of power. I am still looking to find a way to resolve this. Thanks for the prayers.

I am going to make a comment on here, to help others in the future. Many wishers have said they have or wanted to go back to school. My DH taught a a technical school for several yrs. The office of the schools will help you get financing and then you will receive checks in your name that you endorse every month. After you graduate, you have 6 months before you have to make payments.If you quit before you graduate, you STILL have to pay back that money.It can run in to some serious money.Please think if this is really what you want, as those bills follow you forever.I think its great that people are going back to school, just be sure.

You could call an attorney but i can tell you that you are responsible to pay off this loan.

I think the only way you can get out of paying your student loans is if your doctor declares you "totally and permanently disabled" and then you have to fill out a ton of forms and your doctor has to fill out forms as well. If you think you may qualify, talk to the loan company and ask for the forms and then talk to your doctor.
Other than that, I don't have any help or advice, but maybe someone will come along who can offer some other help.

I'm sorry to say that is one thing everyone is responsible for paying back is student loans. It can't even be dismissed in bankruptcy court. Wishing you lots of prayers.
